1. Acceptance of Terms
By accessing or using the ClosetCam mobile application and related services (collectively, the "Service"), provided by Wcomm Gerenciamento de Sistemas Digitais Ltda. ("Company," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Use ("Terms").
If you do not agree to these Terms, please do not use the Service.
2. Description of Service
ClosetCam is an AI-powered virtual try-on application that allows users to upload photos and generate visualizations of clothing items on their likeness. The Service utilizes advanced artificial intelligence models to process user images and create tailored stylistic outputs.
3. Subscriptions and Payments
ClosetCam offers premium features through subscription plans (e.g., Weekly, Annual). Payments are processed securely via the Apple App Store.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Account will be charged for renewal within 24 hours prior to the end of the current period.
- Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's iPhone Settings after purchase.
4. User Content and Photos
You retain all rights to any photos or other content you submit to the Service ("User Content"). By uploading User Content, you grant us a temporary, non-exclusive, royalty-free, worldwide license to use, process, and modify the User Content solely for the purpose of providing the Service (i.e., generating AI try-ons).
We do not use your photos to train our public AI models without your explicit consent.
5. Acceptable Use
You agree not to use the Service to:
- Upload content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
- Upload images of individuals without their consent, particularly minors.
- Attempt to reverse engineer, decompile, or disassemble any part of the Service.
6. Intellectual Property
The Service, including its original content, features, and functionality (excluding User Content), are and will remain the exclusive property of Wcomm Gerenciamento de Sistemas Digitais Ltda. and its licensors. The Service is protected by copyright, trademark, and other laws.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy of the AI-generated images, the reliability of the service, or fitness for a particular purpose.
8. Limitation of Liability
In no event shall Wcomm Gerenciamento de Sistemas Digitais Ltda., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
